The European Broadcasting Union (EBU) values your privacy and is committed to protecting your personal information. This Privacy Notice outlines how EBU collects, uses, stores, and protects personal information when facilitating access to its EuroVOX translation and AI-powered services. The terms "Controller," "Data Subject," "Personal Data," "Process," and "Processing" shall have the meaning set out in the applicable Data Protection Laws, including GDPR, Swiss Federal Act on Data Protection (FADP), and any other relevant privacy laws. Where EBU acts as Processor of personal data on behalf of Members, processing is further governed by the Data Processing Agreement, available at https://www.eurovox.io/dpa.html.

1. Who We Are

The European Broadcasting Union (EBU) acts in two distinct capacities in relation to personal data processed through the EuroVOX platform. In respect of identity data (including user IDs and account information managed via EBU's authentication systems), usage analytics, and records of user actions within the platform, EBU acts as data Controller, determining the purposes and means of processing. In respect of personal data contained within content submitted by Members for processing (such as audio recordings, text, and video), EBU acts as data Processor, processing that data solely on Members' instructions and in accordance with the Data Processing Agreement. Members act as Controllers in respect of the content they submit.

2. Personal Information We Process

EBU collects and processes the following types of personal information via the EuroVOX platform:

Contact Information: Names, job titles, professional email addresses, phone numbers.

Input Data: Personal information contained within audio recordings, text, or submitted inputs provided by Members for processing through third-party AI services.

Operational Data: Actions performed when using the EuroVOX platform, including device IDs and metadata necessary for service functionality.

This Privacy Notice clarifies that any submitted Input Data is the responsibility of Members, who act as Controllers and must ensure lawful collection and processing, including appropriate consent from Data Subjects.

3. Basis for Processing and Purpose

Personal Data included in the platform is processed on the following legal bases:

Performance of Contract: To deliver services as outlined in agreements between EBU and its Members.

Legitimate Interest: To ensure security of the EuroVOX platform for translation and transcription purposes and improve its functionality.

Lawful Basis: Where Input Data contains personal information, Members must ensure they have an appropriate lawful basis for processing under applicable data protection law. Where Input Data includes special category data (such as biometric or health data), Members must ensure they have a valid basis under Article 9 GDPR.

Processing is strictly limited to the purposes of facilitating services, compliance with legal frameworks, and enabling governance among EBU Members. Personal Data is not processed for marketing or promotional purposes.

4. Sharing and Transfers of Personal Data

Personal Data may be shared with:

Third-Party Providers: Personal data contained within Member-submitted content may be shared with approved sub-processors engaged by EBU to deliver transcription, translation, voice synthesis, and related services. A full list of approved sub-processors is available at https://www.eurovox.io/subprocessors.html.

Web3Forms: The contact form on the EuroVOX website uses Web3Forms (web3forms.com) solely to relay enquiry messages to EBU. When you submit the contact form, the name, email address, and message you provide are transmitted to Web3Forms' servers for delivery to EBU. Web3Forms does not use this data for any other purpose. No cookies are set by Web3Forms.

Legal Authorities: When required by law or regulatory obligations.

To enable cross-border services, data may be transferred to jurisdictions outside the EEA or Switzerland, with safeguards implemented such as Standard Contractual Clauses (SCCs) and supplementary measures to ensure compliance with Data Protection Laws.

5. Responsibilities of Members

Members must ensure that:

Consent and Accuracy: They have obtained appropriate consent from individuals whose personal data is submitted for processing via EuroVOX. Input Data must comply with applicable laws and EBU guidelines.

Data Compliance: They inform Data Subjects about their rights, including access, rectification, objection, and portability, as outlined in privacy regulations.

EBU relies on Members to verify and continuously improve the accuracy of any submitted personal data.

6. Retention of Data

Data retention policies depend on the agreement terms:

Personal Data is retained by EBU only for the duration necessary to provide the services requested by Members or meet legal obligations.

Upon termination, Members may instruct the erasure of processed data unless legal requirements mandate its retention. Members requiring an export of their data should request this prior to termination.

Backup processes ensure data removal within specified deadlines, aligned with service agreements.

7. Security Measures

EBU has implemented technical and organizational measures to ensure the confidentiality, integrity, and availability of Personal Data submitted via the EuroVOX platform.

8. Rights of Data Subjects

Under applicable Data Protection Laws, Data Subjects have the following rights:

Access: To view how data is processed by EBU or third-party Providers.

Rectification: To correct or update details processed unnecessarily.

Erasure: To remove data in compliance with the "Right to be Forgotten."

Restriction: To limit data processing activities.

Objection: To object to the use of personal data in specified cases.

Portability: To transfer data to another Controller in machine-readable formats.

Where an update materially affects the processing of personal data, Members will be notified in accordance with the notice provisions of the Terms and Conditions.
